TITLE 18, USC 2257 COMPLIANCE

In accordance with US Law - Title 18, US Code 2257 - ALL models depicted in photos and video created by Shadowplay Imaging (SPI), and displayed on the Shadowplay Imaging (SPI) Web Site were 18 years of age or older on the date they were photographed or videotaped.  SPI maintains 2257 documentation and has the appropriate recordation required by law on file for every model we photograph.  SPI is NOT responsible for records pertaining to Guest content from other producers or sites linked from or to SPI.

SPI states that ALL images and video were created after 7/3/95 and are in compliance with 18 USC 2257 and applicable US Federal Laws and associated regulations. Model Releases and Proof of Age documentation for each production and every model represented, pursuant to Title 18, US Code 2257, are maintained on file by the custodian of records, Shadowplay Imaging - Custodian of Records is George W. "Bill" Richards (AKA "SEETHER"), Producer, et. al.

Because SPI produces and maintains all materials and products in a private residence and not a locked, secure, guarded facility (or with a legal representative), we WILL NOT post the street address of the actual location of the stored records pursuant to Title 18, US Code 2257.  Information regarding the actual location of the required documentation pursuant to Title 18, US Code 2257 may be obtained by a LEGAL REPRESENTATIVE of any state or federal agency seeking to review, inspect, or confiscate said documentation.  Said representative will provide warrant, subpoena, or summons with first written contact to SPI.  We will only release this information to representatives of the US Attorney's Office.

"SPI creates bondage erotica in which a female subject is videotaped or photographed while bound and gagged.   At no time is anyone in any SPI production abused or mistreated in any way.  At no time is a weapon or threatening device used to coerce any subject in any dramatic portrayal.  At no time is any whip, flogger, crop, or paddle used in any abusive manner.  At no time is any phallic implement or instrument (DILDO or Vibrator) depicted in photographs or video created by SPI.  At no time are the female subjects at SPI displayed with their genitalia exposed.  In 99% of SPI productions, female subjects are wearing an undergarment of some sort to cover their genitalia.  At no time is any sexual touching of any person allowed during an SPI production - including the fondling of breasts or the touching of the pubic or vaginal area, over or under clothing - or on bare skin.  If there is a male subject in the frame with a female subject, it is the producer, who also does the bondage "rigging" or the actual binding and gagging of the female subject.  Any dramatic portrayal is done to enhance the theme of the photo or video, or to achieve the desired effect for whatever type of image is being created.  Physical manipulation of the breasts or nipples is sometimes conducted to achieve a specific dramatic or photographic effect.  this is not done to torture or torment anyone - but only to enhance the bondage for the female subject, and to enhance the fantasy of the viewer.  SPI does not see this as being any different than the binding of the hands or feet - or the packing of the mouth with cloth to form a gag.  SPI focuses it's production theme on consensual bondage and fantasy role-play.  Many people seek out or products because of the emphasis on consent - even in the most "extreme" circumstances.  In many of our productions, female subjects are seen laughing, smiling, and enjoying themselves while they work.  In many instances, female subject will bind and gag themselves on camera in depictions of "self-bondage" - seeking the comfort of their restraint, or simply preparing themselves for their partner or lover.  To us, and to those who come to SPI for their bondage entertainment, there is nothing obscene or dirty about that - and this is most definitely not considered by those who understand our work to be "ABUSIVE."

We believe the material created by SPI is exempt under USC 2256 SEC 75.7 - since SPI creations do not depict "sexually explicit conduct", nor do they depict "sadistic or masochistic ABUSE".  By definition, this exempts SPI from these requirements.  Whereas it is the belief of SPI that we are exempt from the mandates of 2257, we DO abide by the law when it comes to the maintenance of ID paperwork and consent releases related to our product, our business, and our models.  SPI is a family - models and producer alike.  SPI feels that the recordation requirements of 2257 serve to protect the interests of all parties involved.  To this end we support USC 2257 and follow the law in spirit and cause.  Our records reflect our compliance.  They are thorough and complete, and are available for inspection upon request.

It is our hope that some flexibility be shown to SPI and other "cottage" producers regarding the disclosure of the location of documentation pursuant to Title 18, US Code 2257.  It is our belief that publicly posting the location of said documents endangers not only the custodian of records, but the protected identity (including SSN and street addresses) of those models depicted in SPI imagery and videos. We believe this information to be protected under the privacy act of 1977.

The nature of bondage erotica places the female subjects who model or perform for SPI in a position of great trust.  Whereas SPI creates images and video to satisfy fantasy, we are painfully aware of the risks involved in cases where a produced fantasy becomes someone's reality.  We do not wish to enable such risk to our models - or to our production staff.  Therefore, we believe that the location of the records pursuant to Title 18, US Code 2257 should be kept confidential until such time that a legal representative - acting in pursuit of a legal endeavor for the investigation or prosecution of SPI - makes the necessary inquiry in writing to access or secure our documentation pursuant to Title 18, US Code 2257.

SPI is a sole proprietorship, licensed in the state of Oregon (USA).  The owner, producer, and sole proprietor of SPI, George W. "Bill" Richards (AKA "SEETHER"), is the sole responsible individual regarding this deviation from the published changes pursuant to Title 18, US Code 2257.  He accepts full responsibility for any penalties incurred in trying to protect SPI's models' personal information.

CONTENT LICENSE

Shadowplay Imaging owns and retains title to; maintains complete ownership of; and legally distributes the content contained hereon. In accordance with this agreement, Shadowplay Imaging grants the licensee non-exclusive license to display the content contained hereon on up to three (3) websites. If content is removed from one site, it may be placed on another site, as long as there are never more than three locations from which the content can be downloaded. An additional licensing fee, equal to no less than $3 per image sold, applies for each set in full inclusive of each additional location that the content is displayed.

Licensee agrees not to sell or distribute the images via any physical or electronic method (Or any other technology not specifically named in this document) without additional permission and payment of licensing fees as described below. Licensee may not alter the images to make them appear to be the copyrighted property of anyone other than Shadowplay Imaging. Licensee may add small URLs or logos to the images as a method of promotion and advertisement only. Licensee may use up to 5% of the images (rounded to the nearest whole number) for banners, logos, and HTML design for the sites on which the images are displayed. Renaming, resizing, cropping, and compressing images is allowed, provided the images are not altered to make them appear to be the copyrighted property of anyone other than Shadowplay Imaging.

Posting individual files to "pic-posts" and newsgroups is allowed. Licensee may not rent, lease, transfer, network, reprise display, or distribute the product materials, except as specifically provided above.

Shadowplay Imaging may revoke licensee's license in the event that licensee violates one or more of the provisions of this license, requests a refund of the license fee, requests a charge back, or if the license payment is deemed not valid. If the licensee declares bankruptcy, the license is automatically revoked. Involuntary revocation of the license does not grant licensee any refund of payment made.

Any modifications not specifically listed in this document are not granted without express written permission of Shadowplay Imaging.

Licensee holds Shadowplay Imaging harmless for any legal issues related to the distribution of the material as it relates to community standards and adult entertainment laws as set forth in any city, county, state or country of licensee and/or their website(s). Shadowplay Imaging does NOT warrant this material to be acceptable in any/all communities, and licensee assumes full responsibility for determining what images are suitable for distribution to various locales.

Licensee pays a one-time fee for a lifetime license, provided they remain in compliance with the statements above.

Shadowplay Imaging states that these images were created after 7/3/95 and are in compliance with 18 USC 2257 and applicable US Federal Laws and associated regulations. Model Releases and Proof of Age for all models are maintained by Shadowplay Imaging. Custodian of Records is George W. "Bill" Richards (AKA "SEETHER")((Producer, et. al.). Owner forbids unauthorized duplication of or distribution of this material. Owner specifically forbids selling or reselling of this copyrighted material to minors, where images of this type are contrary to applicable laws or regulations, or where it might be offensive to local community standards.

This agreement shall be binding on any successors of the parties. Licensee does not have the right to assign its interests in this agreement to any other party, unless the prior written consent of Shadowplay Imaging is obtained and an administration fee is paid. A transfer fee of 25% of purchase price, where the minimum purchase price equals $3 per image sold, applies for each set.

This document contains the entire agreement of the parties and there are no other promises or conditions in any other agreement whether oral or written. This agreement supersedes any prior written or oral agreements between the parties. This agreement goes into effect upon delivery of the images and this agreement, whether transmitted physically or electronically.

If any provision of this agreement shall be held to be invalid or unenforceable for any reason, the remaining provisions shall continue to be valid and enforceable. If a court finds that any provision of this agreement is invalid or unenforceable, but that by limiting such provision it would become valid or enforceable, then such provision shall be deemed to be written, construed, and enforced as so limited.

The failure of either party to enforce any provision of this agreement shall not be construed as a waiver or limitation of that party's right to subsequently enforce and compel strict compliance with every provision of this agreement through due process of law.

TERMS OF USE

AGE AND LEGAL ACCESS CERTIFICATION

By subscribing to Shadowplay Imaging (www.shadowplayimaging.com or www.doraeme.com), you certify that you are 18 years of age or older; that you are familiar with all local laws in your area affecting your legal right to access erotica or adult-oriented materials; that you have the legal right to access adult-oriented materials and Shadowplay Imaging has the legal right to transmit them to you; that you are requesting adult-oriented materials for your own private enjoyment and that you will never share these materials with a minor or in ANY WAY make these materials available to a minor.

Other trademarks and service marks featured on Shadowplay Imaging are displayed pursuant to licenses obtained from the owners and/or holders of those trademarks and service marks, and may not be used publicly without the express written consent of the owners and/or holders of such trademarks and service marks.

COPYRIGHTS

Except for public domain material and electronic messages, all materials on Shadowplay Imaging are protected by Federal copyright and are protected under treaty provisions and worldwide copyright laws. Materials contained in any part of Shadowplay Imaging may not be reproduced, copied, edited, published, transmitted or uploaded in any way without the written permission of Shadowplay Imaging. Except as expressly stated in the Limited License provision in these Terms of Use, Shadowplay Imaging does not grant any express or implied right to you under any of his trademarks, service marks, copyrights or other proprietary information.
